Eminent Domain - Taking Private Property for Public Use.

COURSE DESCRIPTION

This seminar will examine individual property rights and the power of the government to take property for purposes that are deemed "for the public good". The Fifth Amendment "Taking Clause" and its' original provisions will be contrasted with modern case law interpretations as they have recently been decided. Included in this discussion are the stipulations and process of eminent domain, inverse condemnation and determining when the taking has occurred. How market value is arrived at for purposes of just compensaion and when it becomes affected during this process are key components of this discovery.
